Gender-Based Violence of LGTBIQ+ Groups in the Face of the Right to Privacy, Discrimination and Criminal Consequences, Lima- Peru

Abstract

The following work contributes to the SDG referring to peace, justice and solid institutions. The main objective of which is to analyze the way in which public demonstrations by the LGBTQ+ community can impact the right to privacy of other people. Methodologically, it is a basic type of research, qualitative approach, hermeneutic phenomenological design; The population is made up of prosecutors, members of the Judiciary and lawyers. To collect data, structured interviews, documentary analysis, and national and international legislation, court rulings and reports issued by the ombudsman's office have been used. As a result, it was obtained that the interviewees agreed on recognizing the legitimacy of public demonstrations by the LGBTQ+ community, respect for the right to privacy of those who may feel uncomfortable, and the need to design policies and spaces that promote inclusion without violating other rights. fundamental. It is concluded that LGTBIQ+ groups suffer from violence when expressing themselves publicly; There is consensus on the importance of inclusion, there are different ways to address and manage challenges related to privacy and individual rights within the context of diversity.
