Civil reparation for physical damage to the person derived from traffic accidents in the Peruvian criminal process

The objective was to analyze the application of civil reparation for physical damage to the person derived from traffic accidents in the Peruvian criminal process, aligned with sustainable development objective No. 16: related to the culture of peace with equitable justice. The methodology was qualitative, basic, descriptive level and thematic analysis design. It is based on the legal security approach that those affected by traffic accidents with physical damage must have, in terms of fair and prompt civil reparation, for which a damage assessment table must be available, quantified according to the degree. of affectation and its projection of recovery over time, as well as collaborating with the judicial system to streamline processes and have a tool for decision-making. As a result, there is no damage assessment table in Peru and the determination of civil reparation is taken indiscriminately by the Judges; the creation of said table is necessary to provide legal certainty to those affected and speed up the processes.
