This research aims to determine how the legal relationship of financial consumers and abusive operations regulated is develop by the Superintendence of Banking and Insurance and AFPs In Lima during the year 2015; The research responds to the qualitative approach, with type of research oriented to the understanding and design of the grounded theory; The population is composed of 10 specialists in the subject who were obtained data through the technique of the interview complemented by the documentary and jurisprudential analysis. In that sense, it was concluded that the rights of the financial consumer in the vast majority have been violated by the financial system, through the application of abusive operations. The Peruvian State, through Law No. 29571 - Code of Protection and Consumer Defense, protects the financial consumer; however, the mentioned Law isn't applied efficiently and that generates vulnerability of the financial consumer rights.
