Abstract

Following the entry into force of the new Criminal Procedure Code , has raised questions about the role of the judge in the new model , some prefer a passive neutral judge supported the idea or fear that the active participation of the judge put in check for impartiality which is often invoked the adversarial principle ; however we believe that we can not turn away from the idea that the fundamental reason for the court, is doing justice in the case and a fair sentence presupposes a more complete understanding as possible of the facts about these concepts say contradictory sustain our reflections taking position on this.
